The Tragic Incident at Ovation Fertility in Newport Beach

Two devastating lawsuits have been filed in Orange County Superior Court against Tennessee-based Ovation Fertility following a heartbreaking incident at their Newport Beach location. In January, an employee mistakenly used hydrogen peroxide instead of a sterile solution to clean the incubator storing the plaintiffs’ embryos, leading to their tragic loss.

The Allegations Against Ovation Fertility

The lawsuits, filed by attorneys Adam Wolf and Melisa Rosadini-Knott, accuse Ovation Fertility of negligence in hiring and supervision, fraud, concealment, and medical battery. The plaintiffs, residents of Orange County identified as A.B. and C.D. and E.F. and G.H., tragically lost viable embryos due to this preventable error.

A Heartbreaking Loss for Would-Be Parents

During a news conference, attorney Adam Wolf expressed the devastating impact of this incident on dozens of would-be parents. The victims lost not only their remaining embryos but also the chance to have biologically related children, a dream that was stolen from them by Ovation Fertility’s negligence.

Ovation Fertility’s Response

Efforts to reach Ovation Fertility for comment on the lawsuits were unsuccessful by the press deadline. The company, founded in 2015 with multiple locations nationwide, offers in vitro fertilization, diagnostic services, donor programs, surrogacy, and fertility storage.

Seeking Justice for the Victims

Wolf clarified that the incident was likely an error rather than intentional sabotage, but the devastating consequences remain. Attorneys are seeking a jury trial for past, present, and future damages, punitive damages, attorney’s fees, and any other relief deemed appropriate by the court.
