In a recent turn of events, Scott Mitchell Brown, a 38-year-old resident of Kerrville, has been sentenced to 42 months in federal prison. The former pharmacy technician at the Veterans Affairs (VA) Medical Center in Kerrville faced charges related to conspiracy to possess with intent to distribute a controlled substance, theft of government property, and possession of stolen mail.

Exploiting Position at VA Medical Center

Court documents revealed that Brown exploited his position at the VA Medical Center to orchestrate a scheme involving the theft and distribution of narcotics intended for VA patients. He was found to have pilfered narcotics from shipments bound for VA patients and sold them for profit within the Kerr County area.

Accomplices in the Operation

One of Brown’s accomplices in the operation was identified as John Swiencki. Swiencki played a role in introducing Brown to another co-conspirator, David Jeffrey Hughes Jr. Together, Brown and Hughes engaged in the criminal activity of breaking into mailboxes and stealing prescribed narcotics from veterans. Brown allegedly utilized patient records obtained through his position at the VA Medical Center to identify specific mailboxes.

Legal Proceedings

In previous legal proceedings related to the same case, Swiencki was sentenced to 12 months in prison in September 2022, while Hughes received a 35-month sentence in December 2022. U.S. Attorney Jaime Esparza for the Western District of Texas expressed outrage at Brown’s actions, stating that his misuse of his position with the VA was a betrayal against our nation’s veterans.

These veterans rely on the care and compassion of the VA to assist them with ailments and disabilities. Instead, the veterans victimized by Brown and his codefendants were met with cruelty and greed. The Department of Justice will continue to seek justice for those who have sacrificed so much for our country.
