Following Megally’s untimely death, his widow, son, and two daughters sought closure by requesting an autopsy to determine the exact cause of his passing. Despite initial agreement from the hospital, the autopsy never took place due to a lack of signed documents from the family. This led to suspicions of negligence on the part of the hospital staff, prompting the family to seek a magisterial inquiry.
The Legal Battle Unfolds
Despite their efforts, the family faced roadblocks in their quest for answers. The duty magistrate initially refused to initiate an inquiry, citing the issuance of a death certificate. Undeterred, the family pressed on, filing a court application for a magisterial inquiry, which was ultimately rejected due to procedural issues.
A Landmark Court Decision
In a groundbreaking ruling, the First Hall, Civil Court declared that the hospital authorities had breached the survivors’ fundamental right to private and family life by denying the family a private autopsy. Mater Dei’s CEO and the Superintendent of Public Health were held responsible for this violation, with the court ordering them to authorize the autopsy within 15 days.

The court mandated that the autopsy be performed at Mater Dei Hospital by two pathologists chosen by the family, with a third pathologist acting as an observer selected by the hospital.
