Man Sentenced to 14 Years for Criminal Sexual Conduct

A Spicer, Minnesota, man, Edward Timothy Russell, has been sentenced to more than 14 years for first-degree criminal sexual conduct after allegedly entering a neighbor’s home in the middle of the night. Russell, 30, entered a Norgaard guilty plea to the charge on June 3 and was sentenced the same day to the statutory maximum of 172 months.

Details of the Crime

According to the criminal complaint, Russell was identified as the suspect in a reported sexual assault of a 90-year-old woman in her Spicer residence. The woman reported that on March 24, 2023, she had gone to bed between 8 and 8:30 p.m. and woke up around 2 a.m. to someone pulling her to the floor and pushing her head and face against the floor before the alleged assault. The charges specified engaging in sexual penetration and causing personal injury by the use of force.

Investigation and Evidence

Multiple items of evidence were collected throughout the woman’s residence, and she underwent a medical examination for the purpose of gathering evidence. A deputy spoke with Russell and his wife, who denied involvement. However, lab results from the medical exam samples revealed the presence of male DNA from sperm cells. A comparison by the BCA lab showed Russell’s DNA profile was a match to the one collected from the examination.

Sentencing and Release Date

Under Minnesota law, offenders are required to serve at least two-thirds of a sentence in custody and may be allowed to serve the remaining time on supervised release. Russell’s expected release date from the Minnesota Correctional Facility in St. Cloud is May 31, 2033, with credit for 206 days already served. Sentencing conditions for him include registering as a predatory offender and serving a conditional release period of 10 years upon release from prison.

Conclusion

The sentencing of Edward Timothy Russell for first-degree criminal sexual conduct serves as a reminder of the importance of justice and accountability in cases of sexual assault. The victim’s bravery in coming forward and the thorough investigation that led to Russell’s conviction highlight the dedication of law enforcement in ensuring perpetrators are held accountable for their actions. As Russell serves his sentence, the community can find solace in knowing that justice has been served..
