The Case of Monteze Morton: DC Superior Court Judge Rules Probable Cause of Murder

DC Superior Court Judge Maribeth Raffinan made a significant ruling on June 27, stating that there was probable cause that a homicide defendant committed a murder. The defendant in question is Monteze Morton, a 21-year-old individual who is charged with first-degree murder while armed for the alleged shooting of 29-year-old Dimitrious Brown on the 2800 block of Hartford Street, SE.

Details of the Incident

According to court documents, the tragic incident unfolded as two individuals were engaged in a heated argument. Brown, in a moment of aggression, attempted to strike an individual who happened to be Morton’s ex-girlfriend. It was at this moment that a third person, identified as Morton, intervened and allegedly shot Brown.

The Defence’s Argument

The defence team representing Morton cited evidence to suggest that their client acted in self-defence. They argued that Brown appeared to be reaching for something near his waistband and had previously assaulted Morton’s friend. However, the prosecution countered this argument by pointing out that Morton did not know the victim prior to the incident, and no firearm was recovered from Brown.

Judge Raffinan’s Verdict

After carefully considering the evidence presented by both the defence and prosecution, Judge Raffinan ultimately ruled that there was probable cause for first-degree murder while armed. She noted that there was insufficient evidence to prove that Morton acted in self-defence, stating, “He acted with a premeditated mindset.”

As a result of the ruling, Morton is currently being held without bond. Additionally, the defence requested to set a trial date during a recent hearing, but the judge denied the request. Parties involved in the case are scheduled to reconvene on Oct. 2 to further address the matter.
