Teenager Involved in Fatal Porsche Accident to Be Tried as Adult by Juvenile Justice Board

In a recent development in the tragic incident involving a teenager mowing down two individuals with his luxury race car in Pune, the lawyer representing the accused has stated that the Juvenile Justice Board will decide whether the teenager should be tried as an adult. Prashant Patil, the lawyer, addressed the media in Pune on May 22, shedding light on the legal procedures that will determine the fate of the accused.

Legal Procedures Under Juvenile Justice Act

According to Mr. Patil, the Juvenile Justice Act mandates specific procedures to determine whether a Child in Conflict with Law (CCL) should be considered a minor or an adult. These procedures typically take around 90 days to complete. If a juvenile or CCL is arrested, investigative agencies must file a charge sheet within 30 days to consider them as an adult. Following this, a two-month procedure ensues, involving psychological and social assessments along with a de-addiction test.

Recent Court Orders and Decisions

The Juvenile Justice Board recently cancelled the bail of the 17-year-old accused and ordered him to be kept in a rehabilitation home for 14 days until June 5. The Board has also directed the investigation agencies to provide regular reports and complaints regarding the assessments conducted on the accused. The final decision on whether to treat the minor as an adult will be made after the completion of these assessments.

Police Investigation and Legal Proceedings

Pune Commissioner of Police, Amitesh Kumar, mentioned that they have filed a review application before the Juvenile Justice Board to allow the accused teenager to be treated as an adult in the case. Additionally, the police have sought the custody of the bar staff who served liquor to the teenager before the fatal accident. The accused’s father, Builder Vishal Agarwal, has also been under scrutiny for his lack of cooperation in the investigation.

Allegations Against Bar Staff and Closure of Establishments

The Pune Excise Department took swift action by sealing the bars that allegedly served liquor to the minor before the accident. The managers of these bars were subsequently arrested by the police. It was reported that there was no board on the premises of the bar indicating that alcohol couldn’t be served to minors. This development has raised concerns about the enforcement of regulations in establishments serving alcohol to underage individuals.
