Martinez allegedly stomped on the guardsman’s knee repeatedly, leading to his arrest and charges of assault on a public servant.
Legal Ramifications
In the aftermath of the incident, at least 57 individuals are facing state charges for participating in the riot. Additionally, some individuals have been federally charged with illegal entry into the United States. Among those charged are Venezuelan nationals Omar Alejandro Graterol Colmenares and Jose Guillarte Acosta.
Graterol and Guillarte were charged with improper entry by an alien and have been transferred between federal and state custody for prosecution. Graterol is being held on a $42,000 bond for charges of riot participation and criminal mischief, while Guillarte has a $57,000 bond for similar offenses.

State and Federal Response
Following the disturbance, Texas deployed an additional 200 National Guard troops to El Paso to reinforce security measures at the border. The state also rebuilt and strengthened the razor wire barriers that were breached by the migrants.
The Texas Department of Public Safety has not yet commented on the incident or whether additional charges against other defendants are pending. The legal proceedings are ongoing, with court records indicating that seven individuals were indicted for riot participation on March 28, while the remaining 50 were charged on March 29.
