BUFFALO MAN PLEADS GUILTY TO NARCOTIC CONSPIRACY AND FENTANYL DISTRIBUTION
In a recent development, Rocco A. Beardsley, a Jamestown, NY man, has pleaded guilty to narcotic conspiracy and distribution of fentanyl causing death. This plea comes with a mandatory minimum penalty of 20 years in prison, with a maximum sentence of life. Beardsley entered his guilty plea before U.S. District Judge John L. Sinatra, Jr., just as jury selection was about to commence in his federal trial.

THE CRIMES COMMITTED
According to Assistant U.S. Attorneys Joshua A. Violanti, Evan K. Glaberson, and Jeffrey E. Intravatola, Beardsley, 38, conspired with seven others between late 2018 and March 2020 to sell methamphetamine, fentanyl, and other controlled substances in the Jamestown area. Tragically, on April 9, 2019, Beardsley sold acetyl fentanyl and fentanyl, resulting in the death of an individual identified as J.A. Following the death, Beardsley took measures to cover up his involvement in the drug overdose, including instructing others to destroy evidence from the scene.
OPERATING IN PLAIN SIGHT
Beardsley was actively involved in the buying and selling of fentanyl and methamphetamine for profit and personal use. He utilised social media platforms to conduct his illicit drug activities and operated out of residences on Sampson Street and Cowden Place in Jamestown. During the course of the investigation, law enforcement conducted five controlled purchases from Beardsley, unveiling his illegal operations.
A NETWORK OF CRIMINAL ACTIVITY
Search warrants executed at residences linked to the drug conspiracy revealed a significant haul of illicit substances and weapons. Law enforcement seized approximately 100 grams of methamphetamine, 66 grams of fentanyl, 28 grams of cocaine, 4 grams of crack cocaine, a 12-gauge shotgun, and drug paraphernalia. Beardsley’s criminal history includes a previous conviction in Federal Court in 2007 for conspiracy to distribute crack cocaine and a conviction in New York State Court in 2017 for Criminal Possession of a Controlled Substance and Narcotic Drug Intent To Sell.
JUSTICE SERVED
A total of seven defendants have been charged and convicted in connection with this case. The investigation was a collaborative effort involving the Drug Enforcement Administration, the Jamestown police Department, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, the New York State Police, and the Town of Ellicott Police Department. Sentencing for Beardsley is scheduled for July 23, 2024, at 2:00 p.m. before Judge Sinatra.
