Windsor police Officers Justified in Exchanging Gunfire, Suspect Faces Multiple Charges
Two Windsor police officers have been deemed legally justified in exchanging gunfire with a man outside a hotel in Windsor on January 7, according to the 8th Judicial District Attorney’s Office. The conclusion was reached following a thorough investigation led by the Loveland Police Department.

In a letter signed by District Attorney Gordon McLaughlin, it was stated that Sgt. Stephen Cantin and Sgt. Siobhan McTighe were within their rights to fire their weapons in self-defense. The officers will not face any charges in relation to the incident. However, the suspect, Damien Jackson, 39, is facing a long list of charges, including five counts of attempted murder, five counts of felony menacing, and three counts of first-degree assault.
The incident began when the Windsor-Severance Fire Rescue Department responded to a fire alarm at the AmericInn Lodge and Suites. It was reported that Jackson, who was later confirmed to be armed with a gun, had pulled the alarm. Upon the arrival of the police, Jackson was located in the parking lot, wearing a reflective vest and holding a firearm.
The officers approached Jackson with caution, ordering him to get off a firetruck. However, Jackson ignored their commands and climbed to the roof of the truck, firing a shot towards the officers. In response, both Cantin and McTighe returned fire from behind a Honda sedan, while taking cover. Jackson fired a total of three shots during the exchange.
During the incident, two civilians who were in a nearby vehicle managed to escape and sought cover behind the Honda with the officers. Additional officers arrived at the scene, and after repeated orders, Jackson finally surrendered and was arrested by the Larimer County Sheriff’s Office.

While the officers and the civilians escaped serious injury, they expressed fear for their lives during the incident. Cantin described feeling something pass by his head, uncertain if it was a bullet or shattered glass. McTighe reported seeing the muzzle blast from Jackson’s gun and believed that he was actively trying to kill them.
The investigation into the incident involved interviews with officers, witnesses, and the civilians present, as well as the review of surveillance and body-worn camera footage. The evidence gathered confirmed that the officers and civilians faced a clear and imminent threat.
Jackson is currently being held on a $500,000 bond and is scheduled to appear in 8th Judicial District Court for a status hearing on March 7. Due to the ongoing criminal charges, details of Jackson’s statement have not been released.
