Indiana Man Faces Up to 16 1/2 Years in Prison for Deadly Active Shooter Threat in Dayton
An Indiana man, Jacob Alan Ashba, 31, of Terre Haute, has pleaded guilty to charges related to a deadly active shooter threat that occurred in June in Dayton, Ohio. The incident drew law enforcement from multiple agencies, including five SWAT teams, to a large brick commercial building.
Ashba pleaded guilty on Friday in Montgomery County Common Pleas Court to reckless homicide, felonious assault discharge of a firearm on or near prohibited premises, and three counts of tampering with evidence. If convicted, he could face up to 16 1/2 years in prison.
The incident took place on June 17 at the Davis-Linden Building on 400 Linden Ave. According to Lieutenant Steve Bauer of the Dayton police Department, multiple 911 callers reported an argument between two groups of individuals outside the building, with some individuals armed with baseball bats. Shots were fired from at least two guns, including a shotgun.

When law enforcement arrived at the scene, they discovered one man deceased and another injured. The deceased was identified as 45-year-old Randy E. Allen of Dayton. The Montgomery County Coroner, Dr. Kent Harshbarger, confirmed the cause of death.
Brian Shaffer, an eyewitness who works at a video production company in the Davis-Linden Building, described the intense police response. He mentioned that SWAT teams were seen searching the building in video footage obtained from We Do Videos.
The response to the active shooter threat involved multiple agencies, including the Montgomery County Sheriff’s Office, Ohio State Highway Patrol, and police from the University of Dayton, West Carrollton, and Trotwood police departments, as well as the FBI.
Ashba was initially arrested in Centerville but was released when charges were not immediately filed. Dayton Police Chief Kamren Afzal explained that the release was due to the need for further investigation to establish probable cause and gather evidence beyond a reasonable doubt.
In August, Ashba was indicted on charges related to the incident, but the grand jury chose to ignore two counts of murder. As part of his plea, an additional felonious assault count and a misdemeanor charge of obstructing official business were dismissed.
Ashba is currently being held in the Montgomery County Jail and is awaiting a sentencing hearing scheduled for February 27..
