Man Accused of Animal Cruelty Charges Found Incompetent to Stand Trial
A 25-year-old man accused of taking two monkeys from the Dallas Zoo has had the animal cruelty charges against him dropped after being found incompetent to stand trial. However, he remains in custody and still faces two burglary charges related to mysterious incidents at the zoo last year.
Davion Irvin has been ordered to a state hospital and is currently deemed incompetent to stand trial, according to court filings. Prosecutors made the decision to dismiss the six misdemeanor animal cruelty charges against Irvin as he had already served the maximum amount of time allowed in jail for these offenses.
The Dallas County district attorney’s office explained that, by law, they were required to dismiss the misdemeanor cases as a year had passed and Irvin’s competency had not been restored.
Although the animal cruelty charges have been dropped, Irvin still faces two felony burglary charges. One is related to his alleged involvement in taking the monkeys, while the other is related to the escape of a clouded leopard named Nova.

Irvin’s arrest came after a series of unusual events at the zoo. First, Nova’s enclosure was cut and she went missing, prompting a search that closed the zoo. Later that day, Nova was found near her habitat. On the same day, a similar cut was discovered in an enclosure for langur monkeys, although none had escaped.
Two weeks later, emperor tamarin monkeys Bella and Finn were reported missing. Dallas police released images of a man they wanted to speak to in connection with the case, later identified as Irvin. Following a tip, police found Bella and Finn in a vacant home.
Irvin was arrested two days later when he was asking about animals at a Dallas aquarium and was recognized by a worker. During his arrest, Irvin allegedly confessed to loving animals and expressed a desire to steal more if released from jail.
Regarding the mysterious death of a vulture named Pin, the zoo stated that the U.S. Fish and Wildlife Service determined the injuries on Pin’s back were consistent with those caused by a predator, possibly a feline. Irvin has not been linked to Pin’s death.
Irvin remains in custody, according to Dallas County jail records. There have been no comments from his attorneys at this time.
