Ingleside Man Charged in Connection with Fatal Head-On Crash in Fox Lake

An Ingleside man has been ordered to remain in custody pending trial after being charged with his fifth DUI offense, which resulted in a tragic head-on collision that claimed the life of a 21-year-old man in Fox Lake. Kevin C. Kaminski, 49, now faces two counts of aggravated driving under the influence causing death and two counts of reckless homicide.

The charges against Kaminski stem from a devastating incident that occurred on the evening of August 24, 2023, on Route 12 near Route 59 in Fox Lake. According to Fox Lake police Chief Dawn DeServi, an investigation revealed that Kaminski was driving a black Cadillac SRX southbound in the northbound lanes when it collided with a Ford work van traveling in the opposite direction.

Both drivers were trapped inside their vehicles and required extrication by firefighters. Anthony Herrera, a young man from Wauconda, who was driving the Ford work van, was unconscious at the scene. Despite prompt medical attention and transportation to Advocate Condell Medical Center in Libertyville, Herrera succumbed to his injuries and tragically passed away.

Kaminski, on the other hand, sustained various lacerations and possible fractures. He was listed as stable during his hospital stay following the crash. It was later revealed that Kaminski was under the combined influence of drugs and alcohol at the time of the incident, as confirmed by toxicology testing. The indictment against him alleges that this impairment rendered him incapable of safely operating a vehicle.

Furthermore, the indictment states that Kaminski acted recklessly by driving intoxicated in the wrong lane and failing to reduce his speed to avoid the collision, ultimately causing Herrera’s untimely death. Shockingly, this was Kaminski’s fifth DUI offense, highlighting a disturbing pattern of behavior.

In a tragic turn of events, it was discovered that Kaminski was already on pre-trial release for another DUI offense at the time of the fatal crash. The charges for the earlier incident were only upgraded to felonies six months later, indicating a delay in the legal process. If convicted for the charges related to the fatal crash, Kaminski could face a sentence of up to 14 years in the Illinois Department of Corrections.

The Lake County Major Crash Assistance Team (MCAT) has been diligently investigating this case, working in collaboration with the Fox Lake Police Department. Multiple law enforcement agencies, including the Lake County Sheriff’s Office, Lake Villa Police Department, Round Lake Beach Police Department, and Round Lake Police Department, have also provided assistance with road closures and traffic control.

As the legal proceedings continue, the community mourns the loss of Anthony Herrera, a young life tragically cut short by the irresponsible actions of another individual..
