Men Arrested for Burglary at Deceased Relative’s Home

Three individuals are now facing burglary charges after they were caught in the act of burglarizing the home of a deceased relative in Gordon, as reported by local authorities.

Police Respond to Disturbance on McKnight Street

According to court documents obtained from Magisterial District Judge Edward Tarantelli’s office, Butler Township Police Officer John Kaczmarcyk was dispatched to a garage on McKnight Street on Wednesday, January 10th, 2024. The report indicated that there were individuals removing items from the garage without permission.

Officer Discovers Unauthorized Activity

Officer Kaczmarcyk was familiar with the address and knew that the owner of the garage had recently passed away. He was also aware of the deceased man’s next of kin and power of attorney. Upon arriving at the scene, Kaczmarcyk found three individuals loading items into a car and pickup truck.

Identity of the Individuals Revealed

The three individuals were identified as 38-year-old Thomas Kelly, 33-year-old Taylor Kelly, and 51-year-old Michael Spirko, all residents of Pottsville. Thomas and Taylor claimed to be great nephews of the deceased owner, stating that they were there to collect belongings that had been willed to them. Spirko, on the other hand, stated that he was there with his friends.

Next of Kin Denies Permission for Property Access

Officer Kaczmarcyk promptly contacted the next of kin, who confirmed that no one had been granted permission to be on the property or remove any items. The men’s claim of “bad blood” between them and the deceased was also noted, suggesting a strained relationship.

Arrests Made and Contraband Found

Considering the circumstances, Kaczmarcyk took all three men into custody. A subsequent search of the arrestees led to the discovery of a small plastic baggie containing a white powdery residue in Spirko’s front pants pocket. As a result, Spirko is now facing an additional charge of possession of drug paraphernalia, in addition to the burglary and criminal trespassing charges faced by all three individuals.

The case is currently under investigation, and the legal proceedings will determine the appropriate consequences for the accused individuals.
