David Padilla Arrested for First Degree Murder in Shooting Death of Devlin Rubi – Bernalillo County DA’s Office

Bernalillo County District Attorney’s Office: Five Jury Trials Set for the Week of January 15, 2024

Albuquerque, NM – The pursuit of justice remains at the forefront for the Bernalillo County District Attorney’s Office. As we enter the week of January 15, 2024, the court will be hosting five high-profile jury trials in Bernalillo County. These trials will shed light on the alleged crimes committed and the accused individuals who are facing charges.

David Padilla, 45, stands accused of First Degree Murder (Willful & Deliberate) with a Firearm Enhancement, Tampering with Evidence, and Receipt and Transportation of a Firearm or Destructive Device by Certain Persons (Felon). On March 6, 2022, APD Homicide detectives arrested Padilla for the shooting death of Devlin Rubi in Northeast Albuquerque. According to witnesses, Padilla and Rubi were involved in a confrontation on the night of March 5th, 2022, which escalated into a fatal shooting. Padilla admitted to shooting Rubi multiple times as Rubi attempted to leave the scene in a vehicle. Doorbell camera footage captured a portion of the incident, with the shooter identified as Padilla. The accused was also wounded during the exchange of gunfire. Padilla, who had a prior conviction for armed robbery and possession of a firearm by a felon, is currently in custody at the Metropolitan Detention Center.

Another case on trial is that of Caley Volante, 35, who was convicted of stalking on October 26, 2023. In 2018, Volante bombarded the victim with hundreds of Instagram messages and letters, and even went to her home, where a relative intervened to protect her.

Two other cases involve charges of Aggravated Battery Against a Household Member (Strangulation or Suffocation) and Criminal Damage to Property (Over $1000) with a Battery charge against a household member. The final case on trial is that of Aggravated Battery (Deadly Weapon) with two counts of Aggravated Assault (Deadly Weapon).

It is important to remember that all defendants are presumed innocent until proven guilty in a court of law.
