Elon Musk, the billionaire entrepreneur and CEO of Tesla, is seeking intervention from the U.S. Supreme Court to overturn a settlement that mandates him to have a “Twitter sitter.” The arrangement requires his tweets about Tesla to be approved by a designated individual prior to posting them. Musk’s legal team argues that the settlement infringes on his freedom of speech, even when his statements are truthful and accurate.

The settlement in question stems from a lawsuit filed by the U.S. Securities and Exchange Commission (SEC) against Musk in 2018. The SEC accused Musk of fraud after he tweeted about taking Tesla private at $420 per share, claiming that he had secured funding for the deal. As a result, the SEC demanded that Musk step down as Tesla’s chairman and imposed a $20 million fine on both Musk and Tesla.

In addition to the financial penalties, the settlement required Musk to have his social media communications regarding Tesla pre-approved by company officials to prevent further misleading statements that could potentially impact the stock market. However, Musk’s legal team now argues that this requirement is excessive and restricts his ability to express himself, even when his tweets are factually correct.

This recent appeal to the U.S. Supreme Court comes after a series of legal battles between Musk and the SEC. Previously, a federal judge rejected Musk’s attempt to have the settlement thrown out, stating that the requirement of pre-approval served the purpose of protecting investors from potential harm caused by Musk’s tweets.

Musk’s presence on Twitter has long been a subject of controversy. His tweets have often sparked controversy, leading to volatility in Tesla’s stock price. While many of his followers find his candid and often humorous tweets entertaining, critics argue that his social media activity can have serious consequences for investors and the market as a whole.

The outcome of this latest legal challenge could have significant implications for the boundaries of free speech for corporate executives. If the U.S. Supreme Court were to side with Musk, it could potentially set a precedent that limits the ability of regulatory bodies to restrict the public statements of company leaders, even in cases where misleading information has been disseminated in the past.

As of now, it remains to be seen whether the U.S. Supreme Court will agree to review Musk’s case and make a final determination regarding the settlement. Until then, the Twitter-sitter and the ongoing scrutiny of Musk’s social media activity remain an integral part of his role as the face of Tesla..
