According to the criminal complaint, Milwaukee police responded to a shooting incident on Thursday, June 8, in the area of 95th and Silver Spring. Upon arrival, a detective discovered a 35-year-old man with gunshot wounds outside a car. Despite attempts to save his life, the victim was pronounced dead at the scene. Interestingly, the victim’s address was found to be less than a quarter mile away from the shooting location.

During the investigation, officers were informed that a suspect matching the description of the homicide suspect had been seen running north on N. 95th Street. Shortly after, it was discovered that a person had entered St. Joseph’s Hospital with a gunshot wound, and that person turned out to be the defendant, Elbert Milan. Milan claimed that he had been asleep in the back of a car when he was awakened by a series of gunshots.

Further evidence against Milan includes witness statements that indicate he had been selling crack cocaine in the vicinity of the shooting. A woman told detectives that she and her friends had been purchasing crack from Milan, either at a nearby McDonald’s or near his residence, in the week leading up to the incident.

Tower data from T-Mobile also placed Milan’s phone in the area of both his residence and the shooting scene during the time of the crime. Additionally, DNA swabs obtained from the vehicle at the scene matched Milan’s DNA profile.
