Mother of Payton Wasson, 22-Year-Old Nampa Man Shot and Killed by Boise Police, Seeks Millions in Damages

The mother of Payton Wasson, a 22-year-old man who was shot and killed by Boise police this summer, has filed a claim against the city seeking millions in damages. Marah Wasson alleges that she has suffered mental and emotional distress as a result of her son’s death and is asking for at least $5 million in compensation.

According to the complaint filed by Wasson’s family, they are also seeking damages for the costs of Payton’s hospitalization before his death, funeral expenses, and punitive damages. They are also requesting compensation for the loss of Payton’s companionship and guidance.

Payton Wasson died at a hospital in Boise on June 25. The exact number of shots that struck him has not been disclosed, but the coroner’s report indicates that at least one bullet hit him in the head. The bullet could not be surgically removed, and Wasson’s family made the difficult decision to take him off life support.

Before filing a civil lawsuit against a public agency in Idaho, it is necessary to file a tort claim. The agency then has 90 days to respond. The city of Boise has not yet commented on the claim, stating that it is too early in the legal process.

The Wasson family is still awaiting the release of police body-camera footage to understand what happened on the night of the shooting. Boise police had been investigating possible gang-related crimes when they encountered Wasson and two others. Wasson fled on foot, and officers saw a gun in his hand. Officer Chance Feldner, with 8 1/2 years of experience, was the only officer to shoot Wasson.

The shooting is currently under investigation by the Critical Incident Task Force. Boise police have declined to release details about the number of shots fired or where they hit Wasson. Mario Garza, one of the individuals with Wasson that night, has since been arrested and faces multiple charges.

Garza is scheduled to go on trial in February, while the Wasson family continues to seek answers and justice for the loss of their son.
