Man Accused of Assaulting Woman at McDonald’s Dies in Police Custody: Xavier Rashawn Moore

A 31-year-old man accused of sexually assaulting a woman at a McDonald’s in Santa Ana was pursued and assaulted by two witnesses before dying in police custody, according to authorities.

Xavier Rashawn Moore allegedly put his hands inside a woman’s pants while she was retrieving something from her car on the evening of October 4. The incident was reported to the Santa Ana Police Department, who released a video summary of the incident on Tuesday.

The victim provided a description of the assailant to a 911 dispatcher, stating that he fled the scene and was being chased by two bystanders who witnessed the assault. Shortly afterward, another person called 911 to report a beating taking place just down the street from the fast food restaurant.

When officers arrived, they found Moore lying motionless on the ground, with one officer remarking that he was likely the suspect from the McDonald’s incident. Despite orders to comply, Moore did not respond, and officers restrained him using handcuffs.

During the encounter, Moore spat out a small bag believed to contain narcotics, although it was not visible in the police body camera footage. He repeatedly claimed that he had been beaten by the two witnesses.

Less than 48 hours later, Moore was declared brain-dead while in police custody due to “underlying medical complications.” He subsequently died during emergency surgery, although the exact cause of death is yet to be determined. The medical examiner’s office is conducting an investigation, and if it is found that Moore died as a result of injuries sustained during the beating, his death may be classified as a homicide.

Authorities are currently examining the circumstances surrounding Moore’s death, including whether he ingested any narcotics from the bag found in his mouth. Homicide detectives, internal affairs investigators, and the district attorney’s office are collaborating on the investigation to ensure compliance with state laws and department standards.

Moore, a resident of Santa Ana, had previously been convicted of indecent exposure, lewd acts with a child under 14, and narcotics possession. The identities of the two men who attacked him have not been disclosed, and charges are not currently being pressed against them.
