Jamie Foxx is facing a lawsuit accusing him of sexually assaulting a woman at a rooftop bar in New York City in 2015. The woman, referred to as Jane Doe in the lawsuit filed on Wednesday, claims the incident took place in August 2015 at Catch NYC & Roof. According to the suit, the plaintiff and her friend were sitting near Foxx and the bar’s co-founder, Mark Birnbaum, when her friend asked Foxx for a photo. Foxx allegedly agreed and made several comments to Jane Doe, including complimenting her body and scent. The lawsuit states that Foxx then grabbed her, moved his hands under her “crop top,” and began touching her breasts. The plaintiff alleges that Foxx also put his hands in her pants and touched her vagina and anus. The incident ended when the woman’s friend came looking for her, and Foxx stopped and walked away. The woman claims that the alleged assault caused her to seek medical treatment and has resulted in emotional distress that will permanently affect her. The lawsuit seeks compensatory and punitive damages from Foxx, Catch, and its employees for failing to prevent the assault. Foxx has not commented on the claims. This lawsuit is one of many filed under New York’s expiring Adult Survivors Act, which allows survivors to file claims regardless of when the alleged assault occurred. The deadline for filing claims is Thursday night at midnight, which has led to a wave of high-profile lawsuits this week, including ones against Axl Rose, Cuba Gooding Jr., Jimmy Iovine, and Bill Cosby.
