In Lansing, Michigan, a tragic incident unfolded last winter that resulted in the death of 35-year-old Nicolas Micko. No charges will be filed against a Lansing police officer and three Michigan State Police troopers who shot and killed Micko, as it has been determined they acted in self-defense.

Michigan Attorney General Dana Nessel announced Tuesday her department has concluded its review of the officer-involved shooting that took place on Jan. 5, 2023.

Details of the Incident

The incident occurred around 5 p.m. on Irene Court, where Lansing police and MSP troopers responded to multiple 911 calls reporting a man, later identified as Micko, behaving erratically and carrying a rifle.

Witnesses stated that Micko was pointing the gun at nearby homes and firing indiscriminately at a neighbor’s property and vacant areas along the street.

Police Response

In response to the alarming reports, a Lansing Police Department sergeant requested the assistance of MSP troopers who were in the vicinity on a surveillance assignment.

Upon arriving at the scene, law enforcement officers heard gunshots and believed they were dealing with an active shooter situation. They swiftly located Micko running towards them on nearby Wayne Street.

Use of Deadly Force

Despite verbal commands to surrender, Micko continued to advance towards the officers. When he pulled a pistol from his waistband and aimed it at the police, they were left with no choice but to open fire, hitting Micko 14 times.

Legal Justification

The Attorney General’s office stated that under the circumstances known to the troopers and officers, their use of deadly self-defense was justified. Law enforcement officers have the same privilege of self-defense as any individual.

Shooting in self-defense requires an honest belief that one is in danger of being killed or seriously injured. The officers’ actions were deemed reasonable and necessary in the face of a perceived threat.
