The lawsuit, filed in 38th Circuit Court, alleges that the driver, Marshella Chidester, acted with gross negligence when she crashed into the Swan Boat Club during a children’s birthday party.

The Victims

The crash resulted in the tragic loss of two children, siblings Alanah Phillips, 8, and Zayn Phillips, 4, both of whom were attending the birthday party. Another child, J.P., was injured in the accident, along with more than a dozen other individuals who were present at the club.

Chidester, who was arraigned on multiple charges including second-degree murder and operating under the influence of alcohol causing death, is currently held at the Monroe County jail. The lawsuit filed by Mariah Dodds, the mother of the deceased children, holds both Chidester and Verna’s Tavern accountable for the tragic incident.

Responsibility of the Tavern

The lawsuit alleges that Verna’s Tavern continued to serve alcohol to Chidester despite her visible intoxication, thereby violating Michigan’s “dram shop” law. This law holds businesses liable for serving alcohol to individuals who are underage or visibly drunk.

Investigation and Response

Following the crash, authorities closed Verna’s Tavern and executed a search warrant to gather more information about the events leading up to the incident. Chidester’s attorney stated that she had only consumed one glass of wine and a bowl of chili at the bar before the crash occurred at the boat club a few hours later.

Legal Representation and Statements

Chidester, who has no prior criminal record and is retired, received treatment for seizures in her legs on the day of the crash. Her attorney described the incident as “absolutely horrible.” An employee at Verna’s Tavern declined to comment and referred inquiries to the restaurant’s attorney.
