Man Sentenced in 2021 Shooting Death at Swannanoa Storage Facility

A man has been sentenced in a 2021 shooting death that took place at a storage facility in Swannanoa, Buncombe County District Attorney Todd Williams announced Wednesday, March 13.

Randall Scott McCaul, 63, will serve 111-146 months (9.25 to 12.17 years) in prison after pleading guilty to a reduced charge of voluntary manslaughter. This comes in addition to the original charges of possession of a firearm by a felon, larceny of a firearm, and breaking and entering a motor vehicle.

Details of the Incident

The incident occurred on November 18, 2021, at East Asheville Storage on U.S. 70 in Swannanoa. Buncombe County sheriff’s deputies responded to a call about a gunshot victim, later identified as Gregory Alan Gaines. McCaul was identified as the shooter and initially charged with first-degree murder.

Evidence later revealed that McCaul shot Gaines after Gaines confronted him with a potentially deadly weapon. This led to the option for McCaul to plead guilty to voluntary manslaughter, as excessive force was used in self-defense.

Legal Proceedings

When a defendant claims self-defense, prosecutors must prove the elements of the crime beyond a reasonable doubt and disprove that the killing was done in self-defense beyond a reasonable doubt. In this case, Gaines’ family was present in court for sentencing and expressed support for the sentence handed down by DA Williams.

Overall, the sentencing of Randall Scott McCaul sheds light on the complexities of self-defense cases and the legal processes involved in such incidents. It serves as a reminder of the importance of thorough investigation and fair judgment in cases of violence.
