Three former residents of Altoona are once again facing obstacles in their quest for justice, as they seek to obtain records relating to their removal from their parents’ custody over 15 years ago. The individuals, now adults, have enlisted the help of attorneys Martell Harris and Roy Huntsman to pursue a federal civil rights case against Clearfield County Children, Youth & Family Services.

Allegations of Improper Removal

The lawsuit alleges that the individuals, known as Matthew, Rebecca, and Isaac Krause, were taken from their home in Altoona as a means to coerce their parents into cooperating with a drug investigation. Initially placed in the care of Blair County child welfare services, the children were later transferred to Clearfield County and placed in a foster home operated by Barbara and Timothy Krause.

Abuse and Neglect

The individuals claim that they endured physical and emotional abuse at the hands of the Krauses, leading to the couple’s arrest and subsequent conviction. While Timothy Krause has since passed away, Barbara remains incarcerated.

Legal Battles

As the attorneys for the individuals seek access to relevant records from both Blair and Clearfield counties, they have encountered resistance from Clearfield officials. In response to subpoenas requesting information related to the case, Clearfield has filed a petition seeking a protective order to prevent the release of certain records.

Challenges and Roadblocks

Clearfield County argues that state law prohibits the disclosure of certain information, citing confidentiality concerns and the involvement of non-party individuals. Despite these challenges, the attorneys are determined to uncover the truth and secure justice for their clients.

Next Steps

A mediation conference is scheduled for March 27, where the parties will attempt to resolve their differences and move closer to a resolution in this long-standing legal battle.
