Teenager awaiting sentencing for delivery of controlled substance causing death

An 18-year-old teenager, Elijah Aguero, is currently awaiting sentencing on a serious charge of delivery of a controlled substance causing death. The incident took place in South Boardman, Kalkaska County, Michigan, on June 13, 2023. Aguero, who hails from Muskegon, was identified as the dealer responsible for delivering the deadly substance that resulted in a fentanyl overdose death.

Investigation and Arrest

Following the tragic incident, detectives from the Traverse Narcotics Team launched a thorough investigation. On July 25, 2023, a controlled purchase of fentanyl was conducted from Aguero in Benzie County, where he was known to frequently engage in illegal narcotics dealings. Subsequently, on September 18, Aguero was arrested and charged with one count of delivery of a controlled substance causing death. Despite being 17 years old at the time of the offense, Aguero was charged as an adult.

Legal Proceedings and Charges

Charges were later authorized by the Benzie County prosecutor’s office for one count of delivery of fentanyl. It is important to note that delivery of a controlled substance causing death carries a maximum penalty of life in prison, while delivery of fentanyl is a 20-year felony. Aguero is currently progressing through the court process in Benzie County for his delivery of fentanyl case.

Collaborative Efforts

The investigation and subsequent arrest of Aguero were made possible through the collaborative efforts of various law enforcement agencies. The Michigan State Police Traverse City Post, Kalkaska County Sheriff’s Office, Homeland Security Investigations Sault Ste Marie, and the Drug Enforcement Administration all played integral roles in assisting the Traverse Narcotics Team.
