The driver, identified as 42-year-old Jervon Harper of San Antonio, Texas, became combative when the officers detected the smell of marijuana in his vehicle and asked him to step out.

As the situation escalated, Harper refused to cooperate and began physically fighting with the officers. It was during this struggle that one of the officers noticed Harper reaching for a handgun. In fear for their lives, both officers drew their duty weapons, with Officer Valladares ultimately firing a single round that struck Harper.
