David Pates, Imprisoned for Indecent Assault, Dies at HMP Birmingham
David Pates, a resident of The Orchard in Powick, passed away at HMP Birmingham on March 18 at the age of 79. Pates had been serving a sentence of 41 months and 15 days since 2007 for indecent assault of a child and possession of indecent images of children.

Prior to this conviction, Pates had a history of similar offenses, including six indecent assaults while working at a swimming pool in 1984 and another indecent assault on a nine-year-old girl in the late 1990s. Due to the severity of his crimes, Pates was jailed indefinitely for public protection (IPP), indicating that he was considered too dangerous to be released unless he could prove he was no longer a threat.
An investigation by the Prison and Probation Ombudsman revealed that Pates succumbed to sepsis from a bacterial skin infection known as cellulitis. The clinical reviewer overseeing his care at HMP Birmingham determined that Pates received appropriate medical attention during his incarceration.
In 2011, Pates attempted to appeal his IPP status but was denied by the Court of Appeal in London. The recent inquest into his death on August 13 concluded that he died of natural causes.
Despite the tragic circumstances of his passing, the ombudsman found no non-clinical issues with Pates’s care leading up to his death. Our condolences go out to those affected by this unfortunate event.
