Recently, DC Superior Court Judge Anthony Epstein presided over a hearing that found probable cause to bring co-defendants Dallas McKinney, 19, and Charles Owens, 24, to trial for first-degree murder while armed in connection to Arianna’s death.
During the hearing, the prosecution presented compelling evidence, including Instagram records linked to McKinney, which allegedly tied him to the crime scene. A video from the day of the shooting depicted McKinney in attire resembling that of one of the shooters seen in surveillance footage.

In a bid to defend their clients, McKinney’s attorney, Rachel McCoy, and Owens’ attorney, Stephen LoGerfo, challenged the evidence presented. McCoy highlighted the lack of distinctiveness in McKinney’s clothing, emphasizing that such items could be easily replicated. LoGerfo, on the other hand, pointed out the absence of witnesses identifying Owens as one of the shooters.
Despite the defense’s arguments, Judge Epstein maintained that there was sufficient probable cause to proceed with the trial. He acknowledged McCoy’s stance on the clothing’s commonality but underscored the significance of the items collectively in identifying McKinney.

In a bid for release, McCoy advocated for McKinney, citing community support and inadequate resources at the DC Jail. She proposed home confinement as a viable solution. On the other hand, LoGerfo did not pursue arguments for Owens’ release, leaving the court’s decision unchanged.
