Jamie Foxx Faces Lawsuit Alleging Sexual Assault and Battery

Actor Jamie Foxx is facing a lawsuit accusing him of sexual assault and battery. The case was filed in the New York Supreme Court on Monday, alleging an incident that took place at the Catch NYC restaurant in 2015. The plaintiff, referred to as Jane Doe in the legal documents, claims that Foxx intentionally and without consent used force to offensively touch her, including her genitalia and buttocks. She asserts that she suffered physical and emotional injuries, anxiety, distress, embarrassment, and economic harm as a result of the incident and is seeking an unspecified amount of damages.

According to the legal papers, the woman stated that Foxx appeared to be intoxicated at the time of the incident. Newsweek reached out to Foxx’s representatives for comment, but there has been no response.

The woman alleged that Catch Hospitality Group co-founder Mark Birnbaum was seated nearby when she approached Foxx’s table to ask for a photo. She claimed that Foxx agreed and complimented her on her “supermodel body.” He then allegedly took her to a secluded part of the restaurant, where he proceeded to touch her breasts and slide his hands into her pants, touching her vagina and anus.

Following the incident, the plaintiff claimed to have suffered physical injuries and sought medical treatment. She stated that she was unable to pursue her usual activities and continues to experience pain, suffering, and emotional distress as a result of the assault.

In addition to suing Foxx, Jane Doe is also suing Catch Hospitality Group and other related business entities for negligent hiring, training, and supervision.

Foxx has not publicly responded to the lawsuit but posted a video on Instagram showing him throwing a football into a basketball hoop. He later disabled comments on the post.

This lawsuit comes amid a wave of high-profile cases filed ahead of New York City’s deadline for the Adult Survivors Act, which allows adult sexual abuse survivors to sue perpetrators, even if the statute of limitations had expired. It was enacted in November 2022 and will end at the end of this month.
